Buying a new construction home in South Florida

New construction can mean modern code, new systems and lower maintenance. Here’s how to buy smart.

Bring your own agent

The builder’s sales staff represents the builder. Register your agent on your first visit — many builders require it — so you have someone negotiating and reviewing documents for you.

Understand the contract

Builder contracts differ from standard resale contracts. Review completion timelines, what happens if construction is delayed, allowances and upgrade pricing, and closing-cost terms.

Protect your deposit

Florida law (s. 501.1375, F.S.) sets rules for how certain buyer deposits on new one- or two-family homes must be held. Ask how your deposit will be held and when it can be used.

Inspect during and after construction

Independent inspections before drywall and before closing can catch issues early, even on brand-new homes. Your contract should allow access for these inspections.

Warranties and defect claims

Get the builder’s warranty in writing and know how to file claims. Florida’s chapter 558 sets a pre-suit notice process for construction defect claims.

Code and insurance

Homes built to the current Florida Building Code, with impact-rated openings and modern roof attachment, may qualify for insurance credits — ask for wind-mitigation documentation at closing.
